This website is operated by LaGrutta Art. Throughout the site, the terms “we,” “us,” and “our” refer to LaGrutta Art.
By visiting our website and/or purchasing artwork or other products from us, you agree to these Terms of Service, along with any additional policies referenced on this website, including our Return & Refund Policy and Privacy Policy.
Please read these Terms carefully before using the website or placing an order.
1. Online Store Terms
By using this website, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have permission from a parent or legal guardian to use this website.
You may not use our products, artwork, website, or services for any unlawful or unauthorized purpose.
2. Artwork & Products
LaGrutta Art offers products that may include:
- Original artwork
- Limited-edition fine art prints
- Giclée and archival fine art prints
- Open-edition prints
- Other art-related products
Original artwork is individually created by the artist and may contain intentional variations in texture, brushwork, surface, collage elements, markings, or other characteristics inherent to handmade artwork.
Prints and other made-to-order products may be produced and shipped by professional third-party production and fulfillment partners.
Product availability may change at any time.
3. Artwork Images & Color Accuracy
We make every reasonable effort to accurately photograph and represent artwork and products.
However, colors and appearance may vary depending on your screen, monitor, device settings, lighting, photography, printing process, materials, and other factors.
For original artwork, texture, dimensional elements, surface variations, and subtle colors may also appear differently in person than they do in photographs.
These normal variations are not considered defects.
4. Original Artwork
Unless otherwise stated, an original artwork listing represents a unique, one-of-a-kind physical work.
Once an original artwork has been sold, it may no longer be available for purchase.
LaGrutta Art retains all copyrights and intellectual-property rights associated with the artwork unless those rights are expressly transferred in writing.
Purchasing an original artwork transfers ownership of the physical artwork only. It does not transfer copyright or reproduction rights.
5. Limited Editions & Fine Art Prints
Limited-edition prints may be produced only in the quantity stated in the applicable product listing.
Where applicable, limited editions may be numbered, signed, accompanied by a Certificate of Authenticity, or otherwise identified as described in the product listing.
Fine art prints, giclée prints, limited editions, and other made-to-order products may be produced after an order is placed and may be fulfilled by third-party production partners.
Minor variations resulting from printing, trimming, materials, or production processes may occur and are not considered defects when they fall within normal professional production tolerances.
6. Intellectual Property & Copyright
All original artwork, images, photographs of artwork, designs, graphics, logos, text, and other creative content displayed on this website are owned by or licensed to LaGrutta Art, unless otherwise stated.
Artwork may not be copied, reproduced, scanned, photographed for commercial reproduction, distributed, altered, used to create derivative works, used on merchandise, resold as reproductions, or otherwise commercially exploited without prior written permission.
Purchasing an original artwork or print does not transfer copyright, reproduction rights, licensing rights, or other intellectual-property rights to the purchaser.
LaGrutta Art retains the right to photograph, display, publish, reproduce, license, and create prints or other reproductions of original artwork unless otherwise expressly agreed in writing.
7. Pricing & Payment
All prices are shown in the currency displayed on the website and may change without notice.
We reserve the right to correct pricing errors, product-description errors, or other inaccuracies.
If an error affects an order that has already been placed, we may contact you before fulfilling the order or cancel and refund the affected order when appropriate.
Applicable taxes and shipping charges will be calculated or displayed during checkout when required.
8. Orders
We reserve the right to refuse or cancel an order when reasonably necessary, including in cases involving suspected fraud, payment issues, pricing errors, inventory errors, or incorrect product information.
If we cancel an order after payment has been received, the applicable amount will be refunded.
Submitting an order does not guarantee acceptance until the order has been successfully processed.
9. Shipping & Delivery
Shipping estimates are provided as estimates and are not guaranteed delivery dates.
Original artwork may be packaged and shipped directly by LaGrutta Art.
Fine art prints, giclée prints, limited editions, and other made-to-order products may be shipped directly by third-party production and fulfillment partners. As a result, items within the same order may arrive separately.
LaGrutta Art is not responsible for delays caused by shipping carriers, customs, weather, incorrect delivery information provided by the customer, or other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate shipping address when placing an order.
10. Returns, Refunds & Damaged Orders
Returns, refunds, exchanges, cancellations, and damaged-item claims are governed by our separate Return & Refund Policy, which forms part of these Terms of Service.
Original artwork and made-to-order products have different return requirements. Please review the Return & Refund Policy before purchasing.
11. Certificates of Authenticity
Certain original artworks and limited editions may include a Certificate of Authenticity.
Certificates are associated with the specific artwork or edition identified on the certificate and should be retained with the artwork whenever possible.
A Certificate of Authenticity does not transfer copyright or reproduction rights.
12. Resale
Purchasers may resell a legally purchased physical original artwork or print, subject to applicable law.
However, resale of the physical artwork does not grant the purchaser or subsequent owner any copyright, reproduction, licensing, or merchandising rights.
No person may create or sell reproductions of LaGrutta Art artwork without prior written authorization.
13. Third-Party Services
Our store may use third-party providers for services including website hosting, payment processing, printing, order fulfillment, shipping, analytics, and other business functions.
Use of those services may also be subject to the applicable provider’s terms and policies.
We are not responsible for third-party websites or services that are outside our control.
14. Personal Information
Your submission and use of personal information through this website is governed by our Privacy Policy.
15. Prohibited Uses
You may not use this website or its content to:
- Violate applicable laws or regulations
- Infringe upon our intellectual-property rights or those of others
- Copy or commercially reproduce artwork without authorization
- Upload malicious code or interfere with website security

16. Disclaimer & Limitation of Liability
To the fullest extent permitted by applicable law, LaGrutta Art will not be liable for indirect, incidental, special, or consequential damages resulting from use of this website, products, or services.
Nothing in these Terms is intended to exclude or limit rights or remedies that cannot legally be excluded or limited under applicable consumer-protection law.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless LaGrutta Art from claims, losses, liabilities, or expenses arising from your unlawful use of the website, violation of these Terms, or infringement of the rights of another party.
18. Severability
If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

The version posted on this website at the time of your use or purchase will govern your use of the site and transaction, subject to applicable law.
20. Governing Law
These Terms of Service and any separate agreements through which LaGrutta Art provides products or services will be governed by and construed in accordance with the laws applicable to LaGrutta Art’s principal place of business, without limiting any consumer rights that apply under applicable law.
